Terms and Conditions

Last modified date:  7 Oct 2026

Article 1: Introduction and Acceptance

(1) These Terms and Conditions (the "Terms") govern the relationship between Eyvar and everyone who uses its platform, riders and captains alike, and form a binding contract between the parties.

(2) Creating an account, requesting a trip, subscribing to a plan or registering as a captain constitutes acknowledgment that you have read and accepted these Terms and the Privacy Policy. Anyone who does not accept them in full must not use the Services.

(3) The Privacy Policy, the annexes attached to these Terms, and the terms of any offer or special service form an integral part of these Terms. The annexes are: the Cancellation and No-Show Policy, the Subscriptions Policy, the Refunds and Wallet Policy, the Captain Agreement, the Captain Commitment and Contractual Compensation Regulation for Subscriptions, and the Conduct and Safety Guidelines. Terms specific to a particular service prevail within that service only, and each annex prevails on the detailed provisions of its own subject.

(4) Nothing in these Terms shall be construed to diminish any non-waivable right guaranteed by the laws in force in the Kingdom of Saudi Arabia.

(5) The Arabic text is the authoritative text; any translation is for reference only.

Article 2: Definitions

The following terms, wherever used in these Terms, have the meanings set out opposite them unless the context requires otherwise:

Eyvar: the entity that owns and operates the Eyvar platform.

Platform or App: the Eyvar rider and captain apps and its website.

Services: what Eyvar provides through the Platform, including booking, matching, payment and support.

Rider: any person who requests a trip, subscribes to a plan or rides in a vehicle through the Platform.

Captain: an independent, legally licensed driver accepted by Eyvar to provide trips through the Platform.

User: anyone who uses the Platform, whether as a rider or as a captain.

Instant Trip: a trip requested for immediate pickup.

Subscription: a plan paid in advance for a set period, comprising scheduled trips on a fixed route, either outbound and return or outbound only, as chosen by the Rider.

Fare: the price of a trip or subscription shown in the Platform, in Saudi riyals, inclusive of VAT.

Wallet: the user's electronic balance within the Platform.

Operational Area: the geographic areas Eyvar activates for each service and announces in the Platform.

Replacement Trip: a subscription trip performed by another captain assigned by Eyvar when the captain assigned to the subscription cannot perform it.

Article 3: Nature and Scope of the Service

(1) Eyvar is a technology platform that connects riders with independent licensed captains, and operates under the necessary regulatory licences. A captain is not an employee or agent of Eyvar.

(2) The Services are provided within the Operational Area announced in the Platform, and both the pickup point and the destination must lie within it. A rider may book while outside the Operational Area provided the trip is within it. Eyvar may expand, modify or define the Operational Area for each service separately, effective from its announcement in the Platform.

(3) The Services include Instant Trips in their categories, Eyvar for Women (in which the trip is assigned to a female captain), Subscriptions, and business services governed by separate agreements. The Platform shows the available categories and their specifications.

(4) Arrival times and routes shown are estimates and may be affected by traffic, weather or road closures.

(5) Eyvar does not guarantee the availability of a captain for every Instant Trip request, and is committed to performing paid subscription trips in accordance with Article 9.

(6) Eyvar may develop, modify or discontinue some of the Services, provided this does not affect subscriptions already paid for, and with prior notice where appropriate.

Article 4: Eligibility and Account

(1) To create an account, the user must be eighteen years of age or older and provide accurate, up-to-date information and an active mobile number verified by a one-time code.

(2) The account is personal and may not be sold, assigned or used by anyone else. Each person may hold only one account.

(3) The user is responsible for all activity on their account and for keeping verification codes confidential, and must notify Eyvar immediately of any unauthorised use.

(4) Eyvar may verify a user's identity by approved means, and may refuse or close any account whose information proves to be inaccurate.

(5) A user may book a trip for another adult from their account and remains responsible for payment and for that rider's compliance with these Terms.

(6) A person under eighteen may not open an account in their own name; their guardian books for them from the guardian's account and is responsible for them. A minor may ride alone only within the limits Eyvar permits and announces in the Platform, and the guardian is responsible for providing any child seat required by traffic regulations.

(7) The user is responsible for providing a compatible device and internet connection, installing mandatory app updates, and any connection charges imposed by their service provider.

Article 5: Instant Trips

(1) The rider specifies the pickup point, destination, category and payment method, and the Platform shows the estimated fare before confirmation.

(2) A trip is formed only when a captain accepts it and the captain's and vehicle's details are shown to the rider, who must verify that they match before boarding. If no captain can be found, the request is cancelled at no charge.

(3) The captain waits for the rider at the pickup point for the period set by the Platform, after which the captain may cancel the trip in accordance with Article 8.

(4) The captain follows the suggested route unless the rider requests otherwise or road conditions require a change. The rider bears no fare increase resulting from an unjustified deviation by the captain.

(5) The destination may be changed or a stop added only through the Platform, and the revised fare is shown to the rider before it is applied.

(6) The number of passengers may not exceed the number of seat belts in the vehicle, and luggage is limited to what the vehicle can hold without damage. Animals are carried only with the captain's consent, except assistance animals accompanying persons with disabilities.

Article 6: Subscriptions

(1) A subscription is a plan paid in advance for a set period, comprising scheduled trips for one rider on a fixed route, either outbound and return or outbound only. The plan type, duration, number of trips and final price are shown before payment.

(2) The rider specifies the pickup point, destination, times and subscription days from the options available in the Platform, and the price varies according to these choices.

(3) A subscription request is offered to available captains for a set period and expires if no captain accepts it within that period. The rider may withdraw the request before it is accepted at no charge.

(4) The full subscription amount becomes due when a captain accepts the request and is paid by card or wallet, not cash. The rider may cancel the subscription before the time of its first trip, and the amount is refunded in full with no deduction. The subscription may not be cancelled after its first trip has started except in the cases set out in Article 9.

(5) The subscription period starts on the date of its first scheduled trip.

(6) Eyvar seeks to keep the same captain for the whole subscription period, and may assign a different captain when needed, with notice to the rider.

(7) A trip the rider misses, or notifies in advance that they do not need, counts as used and is not compensated. The subscription does not include freezing or postponement.

(8) Subscription details may be modified through the Platform under the conditions announced there and subject to availability, with any price difference settled.

(9) The subscription renews automatically at the end of its period unless the rider stops renewal before the charge date. The rider is notified sufficiently before renewal of the price and the charge date.

Article 7: Fares and Payment

(1) Fares are set according to the price card announced in the Platform and include VAT. An electronic tax invoice is issued for every transaction in accordance with applicable law.

(2) Instant Trip fares may rise when demand is high, provided the price is shown before the request is confirmed. The subscription price does not change during its paid period.

(3) Cards and the wallet are accepted for all services; cash is accepted for Instant Trips only.

(4) Eyvar collects the fare as a limited collection agent on behalf of the captain, and payment to Eyvar discharges the rider's obligation to the captain, without prejudice to Eyvar's direct obligations to the rider for subscriptions.

(5) If collection from the primary payment method fails, Eyvar may collect from an alternative saved method or from the wallet, and suspend new requests until payment. Amounts due for cash trips are recorded as a debt on the account, payable before any new request.

(6) Wallet balance may be used only within the Platform. Balance topped up by the user, and balance credited for paid trips that were not performed, are refunded under the Refunds and Wallet Policy. Promotional credit has a validity period shown in the Platform and cannot be exchanged for cash.

(7) Eyvar may offer promotions and promo codes that differ between users and may stop them at any time; no one may claim an offer not made to them. Any benefit obtained by fraud or in breach of the offer's terms is forfeited. No additional balance is granted in return for topping up the wallet.

(8) If the VAT rate or its regulatory treatment changes, the change applies from its effective date and subscriptions paid before it are honoured, unless the law requires otherwise.

Article 8: Cancellation and No-Show

(1) The rider may cancel an Instant Trip; cancellation or no-show fees apply according to the Cancellation Policy announced in the Platform at the time of the request.

(2) No cancellation fee is due if the cancellation is attributable to the captain or to Eyvar.

(3) The rider may withdraw a subscription request before it is accepted at no charge. The rider may also cancel the subscription after payment and before the time of its first trip, and the amount is refunded in full with no deduction. After the first trip has started, the subscription may not be cancelled or its price refunded because of a change in the rider's circumstances; the rider may still stop renewal.

(4) Eyvar may terminate the subscription of a rider who repeatedly fails to show up without prior notice, and the value of the remaining trips is refunded after deducting the actual damage caused by the no-shows, itemised to the rider.

Article 9: Replacement Trips and Refunds

(1) Amounts paid are not refundable except in the cases set out in these Terms, which are a right of the rider and not a grant from Eyvar.

(2) If the subscription captain cannot perform any trip, Eyvar is committed to providing a Replacement Trip at no additional cost to the rider. If a Replacement Trip cannot be provided, the value of that trip is added to the rider's wallet.

(3) For the purposes of this Article, the value of a single trip is calculated by dividing the subscription price paid by its number of trips.

(4) If Eyvar terminates a subscription because it is unable to provide the service, the unused value is refunded in full to the original payment method. If the service stops due to force majeure, the subscription period is extended by the number of days of the stoppage, or their value is added to the wallet if extension is not possible.

(5) The difference is refunded if the service was provided in a lower vehicle category than the one paid for, and any amount charged without right is refunded in full.

(6) Amounts due under this Article are added to the wallet as soon as they are approved, and refunds return to the original payment method within the bank's usual processing time.

(7) Objections to any amount are submitted through the Platform, and Eyvar decides them based on the trip records.

(8) Nothing is refunded for trips the rider missed; where the subscription is terminated due to the rider's breach of these Terms, the value of the remaining trips is refunded after deducting the actual damage caused by the breach.

Article 10: Rider Obligations

(1) The rider must be on time, wear a seat belt, and respect the captain, public decency and applicable laws.

(2) The rider must not smoke in the vehicle, carry prohibited or dangerous materials, engage in verbal or physical abuse or harassment, ask the captain to break traffic rules, carry more passengers than permitted, or photograph the captain or publish their images without permission.

(3) The rider must pay only through the Platform and must not agree with the captain on trips or payments outside it.

(4) The rider bears the reasonable cost of cleaning the vehicle or repairing damage caused by them or their companions beyond normal wear, once the damage is established and the rider has been informed of the amount and supporting evidence. The rider may object before the charge.

(5) The captain may end the trip at a safe location if the rider breaches this Article, and must report it immediately through the Platform.

Article 11: Captain Obligations

(1) The captain must keep all required regulatory documents and licences for themselves and their vehicle valid; expiry of any of them suspends the account until renewal.

(2) Only the registered captain may drive, using the vehicle registered in the Platform, which must be clean, sound and match its announced category.

(3) The captain must comply with traffic laws and the instructions of the competent authorities, respect riders, follow the set route, and not pick up anyone else during the trip.

(4) The captain is strictly prohibited from accepting any payment outside the Platform, asking the rider to cancel the trip, offering to transport them outside Eyvar, retaining or using riders' data, or allowing anyone else to use their account. These violations result in a permanent ban.

(5) Subscriptions accepted by the captain take priority over everything else, and being busy with an Instant Trip is not an excuse for being late for a subscription.

Article 12: Captain Commitment to Subscriptions and Consequences of Breach

(1) A captain's acceptance of a subscription is a commitment to perform all its trips on time throughout its period, and to confirm them through the Platform as Eyvar specifies.

(2) If the captain cannot perform a trip, they must decline it through the Platform at least twelve hours before the pickup time; a timely decline carries no penalty. A decline made after that time counts as an absence.

(3) Failing to show up for the rider is not an option available to the captain. Absence from a subscription trip without a prior decline under the preceding clause is a serious breach of the captain's obligations, for which the following consequences apply progressively according to the number of absences within any thirty consecutive days.

(4) First absence: the value of the Replacement Trip is deducted from the captain's earnings, the captain pays a known financial compensation, announced to them before they accept the subscription and proportionate to the harm, and a warning is sent to the captain through the Platform.

(5) Second absence: the financial consequences in the preceding clause apply, the subscription in which the absence occurred is withdrawn from the captain, assignment of any new subscription to the captain is suspended for fourteen days, and a final warning is sent through the Platform.

(6) Third absence or more: all current subscriptions are withdrawn from the captain, the value of the Replacement Trip and the financial compensation are deducted, and the captain is barred from subscriptions for ninety days.

(7) If the captain is absent from a subscription trip within six months after the end of the bar, the captain is permanently removed from subscriptions, and Eyvar may terminate the account entirely.

(8) These consequences are shown to the captain upon accepting each subscription and upon confirming its trips, and acceptance constitutes acknowledgment of them. The Captain Commitment and Contractual Compensation Regulation for Subscriptions sets out what counts as an absence, confirmation times, lateness limits, how the financial compensation and its cap are calculated, and the appeal procedure.

(9) The captain is exempt from these consequences only in case of force majeure or a sudden emergency proven to Eyvar's satisfaction, and may appeal any consequence applied to them.

Article 13: Captain Earnings

(1) Eyvar is entitled to a commission on every fare at the rate stated in the Captain Agreement and shown in the Platform; the rate does not change for a subscription the captain has already accepted.

(2) The captain's earnings for each trip become due on its completion and are paid to a bank account in the captain's name according to the schedule in the Captain Agreement.

(3) If the rider does not show up after the captain has waited and notified them through the Platform, the captain is entitled to an amount set out in the Captain Agreement.

(4) Eyvar's commission on cash trips is recorded as a debt on the captain and deducted from their earnings. Cash trips are suspended if the debt exceeds the announced limit, until it is settled. No cash is received for subscription trips.

(5) The captain's tier and incentives are set according to criteria announced in the Platform, and a rating below the set threshold places the account under review.

(6) The captain bears the costs of their vehicle and its operation, their traffic fines, and their personal regulatory and tax obligations.

Article 14: Safety, Complaints and Lost Items

(1) In an emergency, the user first contacts the competent authorities, then reports to Eyvar through the Platform.

(2) Eyvar records the trip's location and timing and the communications made through the Platform, and uses them to verify reports and resolve disputes.

(3) Eyvar takes action proportionate to the seriousness of a report, ranging from a warning, to immediate suspension of the account during investigation, to a permanent ban and reporting to the competent authorities in cases affecting safety.

(4) Complaints are submitted through the Platform or the announced contact channels, and Eyvar undertakes to review and decide them within a reasonable time.

(5) Lost items are reported through the Platform as soon as possible, and Eyvar coordinates with the captain to return them. The captain must report and safeguard anything found in their vehicle. Eyvar is not liable for lost items unless the captain is proven to have deliberately kept or destroyed them.

(6) The rider and the captain rate each other after every trip; ratings must be honest and free of abuse.

Article 15: Suspension and Termination

(1) A user may close their account at any time, subject to the following: the price of a subscription whose first trip has started is not refunded, and wallet balance the user topped up is refunded. A captain with an active subscription may close their account only with prior notice sufficient to transfer the riders; otherwise this counts as a single absence and their current subscriptions are withdrawn.

(2) Eyvar may suspend or terminate an account, informing the holder of the reason, in the following cases: harm to safety, assault or harassment; fraud or use of false data or documents; dealing outside the Platform; expiry of mandatory documents; repeated absence or no-show; non-payment of amounts due; breach of these Terms; and a request from official authorities.

(3) If Eyvar terminates a rider's account for a reason not attributable to them, the unused value of their subscription is refunded in full. If termination is due to the rider's breach, the value of the remaining trips is refunded after deducting the actual damage caused by the breach.

(4) The account holder may appeal a suspension decision through the Platform. Amounts owed on the account remain payable after its closure.

Article 16: Personal Data

(1) Eyvar processes personal data in accordance with the Personal Data Protection Law and its regulations, and with the Privacy Policy published in the Platform.

(2) Eyvar collects the data necessary to provide the Services, ensure their safety and meet its regulatory obligations, including account data, location during the trip, trip history and payments.

(3) Each party to a trip sees only as much of the other party's data as is needed to perform it; the captain is prohibited from retaining or using riders' data after the trip ends.

(4) Eyvar does not sell personal data, and discloses it only to service providers committed to protecting it, to insurers to the extent needed to process a claim, or to official authorities on request in accordance with the law.

(5) The user may request access to, correction or deletion of their data, unless the law requires it to be retained.

(6) Trip, payment and safety notifications are part of the Service, and Eyvar is not responsible for the consequences of a user disabling them. Marketing messages are sent only with the user's consent, which they may withdraw at any time.

Article 17: Intellectual Property and Acceptable Use

(1) The Platform, the name "Eyvar", its logo and its content are the exclusive property of Eyvar. Eyvar grants the user a personal, limited, non-exclusive and non-transferable licence to use the Platform for its intended purpose, which ends upon breach of these Terms.

(2) It is prohibited to copy, modify or reverse-engineer the Platform; use automated programs for booking or data collection; manipulate location data; attempt unauthorised access or disrupt the Service; or use the Services for a commercial purpose without prior agreement with Eyvar.

(3) The user warrants that documents, images or ratings they upload are accurate and owned by them, and grants Eyvar the right to use them to operate and improve the Services. Eyvar may remove any abusive or unlawful content, and submitting forged documents results in a permanent ban and being reported.

(4) The App is downloaded from app stores, which bear no responsibility for the Services. Third-party services integrated in the Platform are subject to their providers' terms.

Article 18: Limitation of Liability

(1) Eyvar provides the Services with reasonable care and is responsible for its obligations under these Terms. It does not guarantee that the Platform will operate without interruption or be free of errors.

(2) To the extent permitted by law, Eyvar is not liable for indirect or consequential damages, such as a missed appointment or lost profit. Except for direct damage resulting from its transgression or negligence, its liability for any claim shall not exceed the total amount the user paid to it in the three months preceding the claim.

(3) Nothing in these Terms limits liability for death or personal injury resulting from negligence, for fraud, or for anything that cannot be limited by law.

(4) Accident claims are directed first to the insurer, and Eyvar assists the injured party with its procedures.

(5) The user shall indemnify Eyvar, its officers and employees against claims, losses and reasonable fees arising from the user's breach of these Terms, misuse of the Services, or infringement of third-party rights.

Article 19: Force Majeure

(1) Neither party is liable for delay or failure arising from events beyond its control, such as official closure orders, severe weather, epidemics and general telecommunications outages.

(2) What arises from force majeure is not counted as a captain absence. Its effects on subscriptions are handled under Article 9, and the captain is paid for the trips performed before the stoppage.

Article 20: Governing Law and Dispute Resolution

(1) These Terms are governed by and construed in accordance with the laws in force in the Kingdom of Saudi Arabia.

(2) The parties shall seek to settle any dispute amicably within thirty days of its notification to Eyvar through its approved channels. If settlement is not reached, the competent courts in the city of Riyadh have jurisdiction.

(3) This does not affect the user's right to file a complaint with the competent government authorities.

(4) The Platform's electronic records constitute evidence unless proven otherwise, and the user may obtain, on request, a copy of the records of their trip relevant to a dispute.

Article 21: Amendments and Notices

(1) Eyvar may amend these Terms and will notify users of material amendments through the Platform fourteen days before they take effect, except for amendments required immediately by law.

(2) Continued use of the Services after an amendment takes effect constitutes acceptance of it. Amendments affecting the captain's obligations require their express consent through the Platform.

(3) Amendments do not apply retroactively and do not affect the price or terms of a paid subscription period.

(4) Notices are sent to the user through the Platform, SMS or registered email, and are deemed received once sent. The user contacts Eyvar through the Platform or the contact channels announced in it.

(5) Electronic consent through the Platform is binding as a signature, and warnings, decisions and notices sent by the means in the preceding clause have full legal effect without requiring any other form.

Article 22: Final Provisions

(1) If any provision of these Terms is held invalid, the remaining provisions remain in force, and the invalid provision is replaced by a valid one that achieves the closest possible effect.

(2) Eyvar's failure to exercise any right is not a waiver of it.

(3) These Terms create no partnership, agency or employment relationship between Eyvar and any user, including captains, other than the limited collection agency set out in Article 7.

(4) The user may not assign their rights or obligations under these Terms to anyone else. Eyvar may do so in favour of any affiliate or legal successor, with notice to users.

(5) The words "includes" and "such as" are illustrative and not exhaustive, and article headings are for convenience and are not used in interpretation.

(6) These Terms and the documents referred to in Article 1 constitute the entire agreement between the parties and supersede any prior terms.

Effective date: These Terms take effect from their publication in the Platform.
